Amanda Bynes was due in court on Tuesday to answer Driving Under the Influence charges stemming back to an arrest in West Hollywood in April last year.
But the 27-year-old has been ruled ‘mentally unfit to stand trial’ according to her lawyer Rich Hutton after he told the judge his client didn’t have the capacity to understand the legal proceedings.
According to TMZ, the judge has transferred the matter to the mental health court for further evaluation.
Bynes could spend another year under an involuntary code at a psychiatric hospital in Los Angeles.
A judge is reported to have granted a ‘long-term hold’ to her doctors, which could last for up to 12 months.
The former child star was hospitalised for mental health problems after starting a fire in a driveway in her home town of Thousand Oaks in July.
According to TMZ, the 27-year-old’s mother Lynn Bynes still has temporary conservatorship over her as she remains under hospital care.
But sources tell the website the former Disney princess will most likely not be held for the entire year – the plan is to keep her for only another 60 days before she is transferred to her mother’s home.
Meanwhile, Bynes’ family has spoken out against statements made by publicist Jonathan Jaxson, who is said to have falsely claimed to represent the troubled star. The Bynes’ attorney Tamar Armanak told E! NEWS ‘Jonathan Jaxson does not represent the Bynes family or Amanda.’ The disavowal came after Jaxson released a supposedly official statement to E.T regarding Amanda’s condition and whereabouts, on Friday. But this is not the first time Jaxson has posed as a star’s spokesperson. Back in 2011 he masqueraded as Kim Kardashian’s former publicist, and made a statement on her behalf regarding her short-lived marriage to Kris Humphries. Needless to say, Kim got a high powered Hollywood lawyer to silence the impostor. Bynes’ spokesperson went on to comment on the perplexing actions taken by Jaxson: ‘We are not sure why he is commenting on Amanda’s health care or representing himself as a publicist hired by her family.’ Adding: ‘Amanda’s family continues to be devoted to their daughter’s well being.’ But this is not the first time Jaxson has pretended to have inside information regarding the troubled actress. In May of this year he tweeted that NYPD were at the star’s apartment, but police soon shot down the rumour saying that the claim was false. In another turn of events, the family’s attorney also revealed that an Amanda look-alike, widely believed to be the star, spotted outside of a medical building two week ago was in fact not the actress
